I arrived at Makkah to perform ‘Umrah. I arrived after the ‘Ishaa’ prayer. I did not pray Maghrib. After tawaf (circumambulating), I combined and shortened Maghrib and ‘Ishaa’, then I performed sa‘y (going back and forth between Mount Safa and Mount Marwah). Is my ‘Umrah valid, knowing that I came from Kuwait by plane?
All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.
Consecutiveness between tawaf and sa‘y is not a condition (of validity). Ibn Qudaamah said, in Al-Mughni: “Consecutiveness between tawaf and sa‘y is not a condition.” Ahmad said: “There is no blame if one delays sa‘y till he rests or till night.” ‘Ataa’ and Al-Hasan did not find anything that there was anything wrong with performing tawaf by day and delaying sa‘y between As-Safa and Al-Marwah to the evening. This was actually done by Al-Qaasim and Sa‘eed ibn Jubayr because consecutiveness is not a condition in (the rounds of) sa‘y itself; so, it is all the more so between it and tawaf.
Therefore, your ‘Umrah is valid, although observing consecutiveness between tawaf and sa‘y is better because this is what the Prophet, sallallaahu ‘alayhi wa sallam, did. Moreover, your shortening of the ‘Ishaa’ prayer is also valid if you did not intend to stay for four days or more.
