If someone damaged something unintentionally and compensated its owner, will such a person or the owner be sinful?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.
Scholars unanimously agree that whoever unintentionally damages something that does not belong to him is not sinning; however, he has to compensate the owner for his loss by paying the price of the damaged item if its value can be known or by giving him a similar item if it is estimated through measurement, weight or number.
It is unanimously permissible for the owner to take whatever compensation he receives whether the damaged item can be valued or measured.
