When I sold my car I said to the person who bought it: ‘I swear to you by Allaah that somebody else offered to pay 25,000 dirhams’, the same sum he wanted to buy it for, in order to convince him to buy it with the very price I have determined. But in fact, no one suggested to me such a sum (of 25,000). Would that Your Eminence tell me what I should do. Many thanks.
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.
Taking a false oath to promote and sell a commodity is one of the gravest sins for which there is a strong threat of punishment.
It is narrated on the authority of Abu Tharr that the Messenger of Allaah, sallallaahu ‘alayhi wa sallam, said: “Allaah Will not Speak with three on the Day of Resurrection: The reminder of favors who never gives a thing to anyone but that he reminds him of his favor; the one who sells his goods by a false oath; and the one who lets his lower garment hang down (below his ankles).” [Muslim]
It is due on you to repent to Allaah The Almighty and beg the pardon of this buyer for falling short of fulfilling his right if you know his place, otherwise you should supplicate Allaah to good for him.
The concluded transaction is valid because its conditions and essential factors were present.
Let us bring to your mind that there is no expiation for a false oath according to the preponderant opinion of scholars because it is a Ghamoos Yameen (an oath that dips the swearer in the Hellfire) which nothing expiates but sincere repentance.
