What is the ruling of a marriage that was concluded by means of magic?
All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and messenger.
If the conditions and pillars of a marriage contract are fulfilled in this marriage contract, then it is valid. Assuming that it was concluded on the basis of magic, the person who did the magic has committed a sin and has made himself prone to the wrath of Allaah The Almighty. That person must sincerely repent to Allaah The Almighty and fulfill the conditions of repentance:
1- He should stop doing the sin and abandon it by shunning magic and all matters that are related to it.
2- Regret his past sins.
3- Be determined not to commit this sin again and start doing righteous deeds in expiation.
Magic is an act of disbelief, and the Sharee’ah penalty for the crime of doing it is to kill the magician. It is impermissible to go to soothsayers, magicians and sorcerers. The Prophet, sallallaahu ‘alayhi wa sallam, said that anyone who went to a soothsayer or a sorcerer and believed what he says, has disbelieved in what was revealed to Muhammad .
