Conditioning her husband not to marry a second wife in the contract

Question

assalamalaikum warahmatullahi wabarakaatuhu 1.who are those people who meets & departs / seperate only for the sake of Allah please explain can they be husband & wife in the hadith of seven people who will be under the shade of allah's arsh on the day of judgement 2.can a woman ask her would be husband in MAHR not to marry anyone except her or can she place this as a CONDITION during nikah.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

Those seven (types of people) whom Allaah will shade on the Day of Judgment as mentioned in the Prophetic narration, among them are “those who love each other for the sake of Allaah, meeting for that and parting upon that”. It means that the reason of their meeting was loving one another for the sake of Allaah; they continued on their love till they parted while being sincere in their mutual love for the sake of Allaah. They sustained on this religious love till death separated them and did not interrupt it for any worldly reason whether they were physically together or not.

We did not find any scholar who included a husband and wife in this category. However, if a husband chooses his wife due to her righteousness and piety, and a wife chooses her husband for the same reason, and they love each other for the sake of Allaah till death separated them, in this case, we hope that the above Prophetic narration will include both of them.

As for conditioning in the marriage contract that the husband may not take another wife; this condition is disliked by many scholars. However, if a wife stipulates such a condition and the husband accepts it, then he has to fulfill it. There is some disagreement among jurists concerning this matter, but for details you may read Fatwa 84251.
