Performing Qiran Hajj without bringing Hady

25-8-2016 | IslamWeb

Question:

This year, Allaah helped us perform Hajj to His ancient House, all perfect praise be to Him for His favor. We intended to perform Qiran and told the journey coordinator about that. However, he took the money of hady (sacrificial animal) in Makkah from us, and not when we were in our country, which is Germany. Does this mean that our Hajj was incomplete since we did not bring hady with us? Please answer our question.

Answer:

All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

First of all, we ask Allaah Almighty to help you and us do what He has enjoined upon us and to accept the righteous deeds from you and us. It is a well-known fact that the hady is obligatory on the performer of Qiran Hajj. Since you paid its price to a reliable person in order to buy it and (slaughter it and) distribute its flesh on the poor dwellers of the Sanctuary, you have fulfilled what is obligatory on you. Your Hajj is not incomplete because you gave the price of the hady in Makkah. You are of those who have not brought the hady with them. In fact, you have missed this act of the Sunnah, just as all or at least most people in our days miss it. However, you are legally excused for that because it is not within your ability.

In his commentary on Al-Muhaththab, Imam An-Nawawi may Allaah have mercy upon him says:

"It should be known to you that bringing the hady with you to Makkah as a pilgrim of Hajj or ‘Umrah is a confirmed act of the Sunnah from which the people, or most of them, have turned away in these days. It is better for one to bring his hady with him from the Meeqat … It is favorable that he should bring his hady with him from his homeland. However, if he does not do so, then it is better to buy it on the way than to buy it from Makkah, and (to buy it) from Makkah (is better than to buy it from ‘Arafah), and (to buy it) from ‘Arafah (is better than to buy it from Mina). If he does not principally bring the hady with him and rather buys it from Mina, then that is permissible, and he will have principally fulfilled the obligation of offering the hady."

Allaah Knows best.
