All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
It is not permissible for you to interfere in the affairs of this girl or to help her in getting Khul’, because this may be considered as spoiling the marital relationship between her and her husband. Spoiling the relationship between a wife and her husband is forbidden as we clarified in Fatwa 92056. Besides, you must stop thinking about her because now she is married.
However, her guardian and her relatives should endeavour to reconcile between her and her husband. If this happens, then praise be to Allaah, but if she really fears to be neglectful about the rights of her husband on her because of hating him, then she has the right to ask for Khul’.
In case her husband divorces her without you causing the spoiling of the marital relationship between her and her husband, and her waiting period finishes, then you may propose to marry her. In any case, if we presume that she stays with her husband or that marrying her has not been facilitated for you after she separates from him, then you should look for another woman to marry, as they are so many women.
On the other hand, how would you know that if you marry her you will be happy? Indeed, there are many marriages that took place because of love but which ultimately failed. Therefore, you should not surrender yourself to fake love illusions.
