Matters Necessarily Known to Be Part of the Religion

Question:

1.What are all of the Ma’lum min ad-din biddarurah (Well known facts of the religion)
2.If I cannot make a ghusl bath or my parents will catch me can I still pray with just Wudu
3.This one is urgent how much remorse do you need to repent.
Please don’t refer me to an existing fatwa.

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

First of all, we have clarified in the question entry section that it is only allowed to send one question at a time in the space provided, that only the first question will be answered if the message includes more than one question, and that the rest of the questions will be discarded. Hence, since the questioner entered several questions, we will answer the first question only.

The matters necessarily known to be part of the religion are those that are equally known by the educated and the ignorant, the men and the women, and all Muslims who are brought up in Muslim countries. Al-Mawsoo‘ah Al-Fiqhiyyah reads: “The matters that are necessarily known to be part of the religion, such as the obligation of prayer, Zakaah, fasting in Ramadhaan, performing Hajj for those who are able to, and the prohibition of Riba (interest), Zina (fornication or adultery), consumption of Khamr (intoxicants), and gambling, is not classified as Fiqh (jurisprudence) because knowledge of those matters is not acquired by deduction but rather by necessity. The proof for this is that such knowledge is acquired by lay-Muslims, women, discerning children, and everyone who is brought up in a Muslim country. It is not unlikely that such rulings are considered tantamount to ‘Aqeedah (Islamic creed) because whoever denies any of them is judged to be a disbeliever.” [End of quote]

Ibn Hajar Al-Haytami  may  Allaah  have  mercy  upon  him said about the guideline of identifying the matter that is necessarily known to be part of the religion: “The guideline is that it must be decisively established and definitive and well known such that it cannot be missed by the lay-Muslims who have access to the scholars to know it a priori without need for study and inference.” [End of quote] He  may  Allaah  have  mercy  upon  him then listed a large number of examples covering the obligations, recommended acts, and prohibitions with regard to beliefs and acts of worship. It is important that we point out to you that it is invalid to perform the prayer while in a state of Janaabah (major ritual impurity) without performing Ghusl (ritual bath) except for a Sharee‘ah-acceptable excuse such as the unavailability of water or inability to use it due to sickness or fear of thirst and the like. Being embarrassed that your parents might notice you is not a valid excuse that makes it permissible for you to not make Ghusl.
