Question:
Kindly tell me if the nikah is based on lie and fruad then what shoud be done. If a person says that he has given divorce to his ex wife and there is no liability on him from her and the daughter is also living with her and i have nothing to do with them, as he is living in America, before getting married second time he never gave divorce to his first one. After his second nikah he filed the divorce case and it can take too long. i married this person but previously he lied to me and married me on telling a lie about so many things regarding his ex-wife, his qualifications his finacial status. I don't find any compatibilty of anything between us I can't live with a person who can do a fraud or tell a lie without caring someones life. I also heard so many bad things about him like fraud. He wants to continue this marriage but I dont want it; What should I do? Thanking you in anticipation.
Answer:
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
If the state is as you described and it becomes impossible to live with your husband, then, you can ask him to divorce you. If he refuses, you can bring a suit against him. Since you live in a non-Muslim country and there is no Sharee'ah court, we advise you to resort to the nearest Islamic Center. The scholars of that Center will study your case and then decide if divorce is needed or not. Know that the ruling that is issued by such scholars is binding on you both. If one of you refuses the ruling of the scholars, then bring the case to state court to remove the harm and put the scholar's ruling in effect.
Allah knows best.
