Question:
I was married to my wife for about a year we were not living together as I was finishing my school and was getting prepared to have proper house for her. I had to visit my parents So I went to Pakistan where they asked me to call her there as she is also from Pakistan, her parents were not there but her other relatives put restrictions for us to meet and when we came back here suddenly she started asking for divorce whereas there was no such issue between us, I told her relatives that she should not travel with any non-Mahram and they said I am putting restrictions on her and then for 15 days I had no clue where my wife was and then suddenly after coming back she just said that she can not live with me and asking for divorce. Whereas I don't see any reason for divorce and I look for advice in which way can I make them and her understand that divorce is some that Allaah disliked the most and without even any reason. What Should I Do?
Answer:
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
It is not permissible for a woman to ask her husband to divorce her without a sound religious reason. The Prophet said: "The smell of Paradise is forbidden for any woman who asks her husband to divorce her without a valid (Islamic) excuse." [At-Tirmithi] Therefore, if your wife asked you to divorce her without any sound religious reason then she is indeed wrong and she is considered a disobedient wife. Therefore, she must be advised and admonished. Then if she takes heed; that is what is required. However, if the situation still continues as it was and marital relationship has worsened between you, then it is more appropriate to divorce her, and you are permitted not to divorce her until she gives you a compensation, this is what is called Khul', on this regard, please refer to Fatwa 89039.
Finally, it should be noted that the family of the wife should not interfere between the husband and his wife to an extent that could spoil their marital relationship.
Allaah Knows best.
