Eligible inheritors after death

Question:

Al Salam Alikom. I have a husband, one daughter only, mother, father, three brothers, and three sisters. I own a house and a pice of land. If I die, who is going to inheret me from these people and what is the percentage of each. Thank you in advance and gazakom Allah Khaira.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

In the mentioned situation all those who are mentioned in the question will inherit except the brothers and sisters since they are blocked because of the existence of the father. The shares for those entitled will be as follows:

The husband is entitled for a fourth-portion of the inheritance, the daughter will get half of the inheritance and each one of the parents will get one-sixth share of the inheritance.

We would like to draw your attention that it is better not to ask such questions before they actually happen. Imaam Maalik may Allaah have mercy upon him used to say: “leave them till they occur”. The reason is that the situation may change.

Allaah Knows best.
